BOOKING CONDITIONS FOR 2012 and 2013
1. How to
make a tour request and book a tour
1.1. A tour request
can be made by fax or by E-mail. Please, try to use E-mails rather
than sending us a fax. You will receive from us an answer within 24
hrs if you send us your E-mail from Monday to Thursday. We are
usually able to send you an offer by 2 days provided that we know
exactly what you would like to experience in Bulgaria.
1.2.
Odysseia-In will confirm your tour provided that we have received a
deposit. Odysseia-In will run your tour provided that you have made
the balance payment in due course.
2. Prices
Our
prices are quoted in EURO currency. We accept payments in EURO or in
BGN (local currency - the Bulgarian Lev). If you wish to pay in BGN
please have in mind the official exchange rate of the Bulgarian
National Bank. It is fixed and never changes: 1 EURO = 1,95
BGN. Prices may be subject to change. Tour prices may alter up or
down by a maximum of 10% due to unforeseen air or ground cost or
exchange rate fluctuations. In the unlikely event that the tour price
increases above 10% for confirmed bookings, clients may cancel with a
full refund of monies paid to us. Prices cannot change in less
than 20 days prior to departure date.
3.
Payment
Confirming a tour means that you have to make a
deposit. The minimum deposit is 10% of the total tour price. We
will tell you exactly how much your deposit is after confirming your
travel needs. The balance of all monies due, including any
surcharges applicable at that time, must be received by Odysseia-In
not later than 20 days before the start of your tour. In the case
of non-payment of the balance by the due date, Odysseia-In reserves
the right to cancel your booking and cancellation charges may
apply. You can pay the deposit and full amount by wiring the
monies to our bank account or by credit card. We accept Visa and
Mastercard. Please tell us if you wish to pay by credit card. If
you wish to pay us with credit card we will send to you a Credit Card
Form for you to fill out. After that you will need to send it back to
us. A credit card fee is payable if you pay us by credit card.
Please ask us how much this credit card fee is for your tour. We will
advise you before taking any payment by credit card. If you wish
to pay us with a bank transfer we will provide you with our bank
account, which is in the First Investment Bank in Bulgaria. If you
wish to make the balance of all monies due in cash this can also be
done - but only in our office in Sofia. Please tell us in advance if
you wish to make this. After the payment is done we will confirm
your tour and you will receive from us a voucher.
In case you
want to pay the whole amount in cash this is also possible. In order
to do this we will send to you a Credit Card Form for you to fill
out. You will need to write down your name, credit card type, etc.
You will have to give us an authorization to use your credit card. We
will then block the deposit in your credit card account. Upon arrival
in our office in Sofia and making the full payment in cash we will
unblock the deposit from your credit card.
4. Rights and
Obligations of the parties
4.1.Rights and
Obligations of Odysseia-In 4.1.1. To provide all tourist
services, paid by the Client, in accordance with the contract. 4.1.2.
Odysseia-In has an insurance contract "Tour operator's
liability" according to clause 42 of the Bulgarian Tourism Law.
It is your right to ask us for our insurance contract and we will
send it to you or show it to you in our office. 4.1.3. Odysseia-In
guarantees the safety of the client's personal data in the matter of
not using them for other purposes (e.g. marketing) without the
permission of the client. 4.1.4. Odysseia-In has the right to
refer to section 6 in case of cancellations. 4.1.5. Odysseia-In
reserves the right to cancel the contract without any consequences,
in case the Client fails to make the balance payment within the
deadline and by the terms of payment, stipulated in the contract and
thus does not carry out his contract obligations. If the Client has
paid the deposit for the tour and has not made the balance payment in
due time, the tour operator retains the deposit.
4.2. Rights
and Obligations of the Client 4.2.1. The Client is obliged to
make a full payment of the tour costs within the terms indicated by
the contract. 4.2.2. The Client is obliged to abide by the laws of
Bulgaria. 4.2.3.The Client has the right to transfer to another
suitable person his rights and obligations in accordance with the
present contract within 20 days prior to departure. In that case both
the Client and the third person are responsible for the balance
payment. 4.2.4. The Client has the right to make cancellations
according to clause 6 of the Booking Conditions. 4.2.5. The Client
has the right to make changes in his/her tour. Changes are only
accepted 20 days before tour start date. Smaller changes (e.g. change
of daily route which does not affect the overnight stay and hotel)
can be accepted 5 days before tour start date - these changes are not
guaranteed but Odysseia-In will do its best to make them possible.
5.
Cancellations
5.1. Each of the parties has the right to
claim change or discontinuity of the contract due to considerable
changes in the circumstances, which have occurred after the moment of
contract conclusion. 5.2. Cancellations are accepted only when
they are written in a letter, E-mail or fax and signed by the
Client.
- 20 and more days before tour start date - retention
of deposit - 10 - 20 days before tour start date - 30% - 10 - 5
days before tour start date - 50% - Less than 5 days before tour
start date - 100%
6. Travelling with us
6.1. The Client,
booking a tour with Odysseia-In is considered familiar with the risks
and the inconveniences of adventure travel. 6.2. The Client is
supposed to be aware of his physical condition and his ability to
undertake the tour without any risk of incurring upon him any health
problems and impeding the normal progress of the tour. 6.3. The
Client accepts the tour leader's authority and respects his
decisions. In case the tour leader - representative of Odysseia-In -
deems a situation dangerous, even if it is included in the program,
he can make changes as to avoid it and this could not be subject to
claims.
7. Liability and Claims
7.1. Odysseia-In
is not liable for non-fulfilment or inaccurate realization of the
contract's conditions, if it is caused by: - the Client - third
party, not involved in the Contract's conditions - force-majeure
circumstances, as: war, civil disturbance, international conflicts,
where one of the parties is involved, terrorist activity, natural
disasters, delay or cancellation of flights, or any other event which
is beyond the control of Odysseia-In and our partners and could not
reasonably be avoided or had not been provided for in the
contract. 7.2. The limit of liability of Odysseia-In cannot exceed
100% of the total cost of the tour. 7.3. Odysseia-In reserves the
right to cancel tours prior to departure for any reason whatsoever,
including insufficient signup, or if there are a force majeure
circumstances. In this case Odysseia-In is not liable for
non-fulfilment of the contract and a refund is due, except for the
expenses already made /insurance, charges for returned airplane
tickets, visa expenses etc/. These expenses must be duly acknowledged
by proper documents. 7.4. Odysseia-In is not liable for
cancellations, delay or changes in the tour's terms and conditions,
not depending on Odysseia-In, as follows: - delays of flights
arising from mechanical failures, bad weather - cancellation or
stop of the tour due to personal reasons of the Client - theft or
loss of or damage to luggage or travel documents during the tour -
any problems with the customs authorities upon leaving Bulgaria or
entering the country of destination, caused by failure to deliver the
necessary travel documents or any law-breaking committed. 7.5. Any
disputes and claims will be arranged by consensus between the
parties. In case no consensus can be worked out the disputes will be
related to a competent Bulgarian court and judged in accordance
relevant Bulgarian laws (The Obligations and Contracts Law). 7.6.
In case of non-fulfilment or inaccurate realization of the contract's
conditions during the tour, the Client is bound to inform immediately
the relevant supplier or Odysseia-In in writing, as for the latter to
be able to react on time with a view to the due taking of adequate
measures as to the satisfaction of all concerned parties. 7.7. In
case the claims of the Client regarding the quality of the provided
services can not be satisfied in the moment of providing the service,
the Client has the right to present a duly drawn up claim to
Odysseia-In not later than 10 days after the end of the tour.
Odysseia-In is obliged to announce a statement regarding the claim
within 30 days after its receipt.
